General terms and conditions of business

  1. Scope These general terms and conditions (hereinafter "GTC") apply to all contracts between [recycling machines Dabrowski] (hereinafter "seller") and the customer (hereinafter "customer") via the seller's online shop.

  2. conclusion of contract

2.1 The presentation of the products in the online shop does not constitute a legally binding offer, but a non-binding invitation to place an order. With the order, the customer makes a binding offer to conclude a purchase contract.

2.2 The seller can accept the customer's offer within five working days by sending the customer an order confirmation by e-mail or by sending the ordered goods to the customer. An automatic confirmation of receipt of the order does not constitute acceptance of the offer.

   3. prices and shipping costs

3.1 The prices given in the online shop are final prices including statutory VAT. In addition, shipping costs are incurred, unless expressly agreed otherwise.

 3.2 The customer bears the shipping costs, unless the seller has agreed otherwise.

   4. terms of payment

4.1 The purchase price is due upon conclusion of the contract.

4.2 The customer can choose between different payment options, which are specified in the online shop.

4.3 If the customer is in default of payment, the seller is entitled to demand interest on arrears at a rate of 5 percentage points above the respective base interest rate pa. The seller reserves the right to assert higher default damages.

   5. retention of title

The delivered goods remain the property of the seller until the purchase price has been paid in full.

   6. warranty

6.1 The seller guarantees that the delivered goods are free from defects.

6.2 If the delivered goods are defective, the customer is entitled to repair or replacement. If both are not possible or if this fails, the customer can reduce the purchase price or withdraw from the contract.

6.3 The limitation period for warranty claims is two years from delivery of the goods.

   7. Liability

7.1 The seller is only liable for damage to the customer if this is based on intentional or grossly negligent behavior on the part of the seller, his legal representatives or vicarious agents. Liability for damage resulting from injury to life, limb or health remains unaffected.

7.2 In the event of property damage and financial loss caused by slight negligence, the seller is only liable in the event of a breach of a material contractual obligation, the fulfillment of which is essential for the proper execution of the contract and the observance of which the customer could trust. Liability is limited to the typical damage that was foreseeable at the time the contract was concluded.

7.3 Liability under the Product Liability Act remains unaffected.

   8. right of withdrawal

8.1 Consumers are entitled to a right of withdrawal in accordance with the statutory provisions.

8.2 The details of the right of cancellation and the model cancellation form are contained in the cancellation policy, which is made available to the customer as part of the ordering process.

   9. data protection

9.1 The seller collects, processes and uses personal data of the customer only in compliance with the relevant data protection regulations.

9.2 The customer has the right to information, correction, deletion or blocking of his personal data at any time.

9.3 Further information on data protection can be found in the seller's data protection declaration.

   10. Final Provisions

10.1 The law of the Federal Republic of Germany applies to the exclusion of the UN Sales Convention.

10.2 If the customer is a merchant, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from or in connection with the contractual relationship is the place of business of the seller.

10.3 Should individual provisions of these General Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.

10.4 The seller reserves the right to change these terms and conditions at any time and without giving reasons. The changed terms and conditions will be communicated to the customer in good time before they come into effect and are deemed to have been approved by him if he does not object within two weeks of receipt of the notification.

   11. Alternative Dispute Resolution

11.1 The seller does not participate in a dispute settlement procedure before a consumer arbitration board.

11.2 The European Commission provides a platform for online dispute resolution (OS), which you can find athttps://ec.europa.eu/consumers/odr/find. However, we are not obliged and not willing to participate in a dispute settlement procedure before a consumer arbitration board.
